Evanston Insurance Co. has filed an action seeking declaratory judgment that it does not owe coverage for defective all-terrain vehicles (ATVs) manufactured by Tank Sports Inc. Tank Sports allegedly provided false information on its insurance application with Evanston. Tank Sports indicated that it had never had a product recall when it knew that was untrue. Tank Sports later became the defendant in underlying cases regarding a product defect. Evanston claims that its policy was issued in reliance on Tank Sports' application and that it should not be required to provide coverage in the underlying cases.
