Sprint, Minnesota AG settle suit about contract extensions, early termination fees

Sprint Nextel Corp. entered into a consent judgment to end a suit by the state of Minnesota regarding contract extensions and termination fees. The consent judgment ends a lawsuit Minnesota Attorney General Lori Swanson filed against Overland Park-based Sprint (NYSE: S) in September 2007 alleging that the company often extended consumers’ contracts for as much as two years without their permission when they made small changes to their wireless phone service, such as adding or decreasing minutes or adding or dropping a family member, Swanson said in a release. The suit also alleged that Sprint charged penalties of as much as $200 a line if the consumer canceled the extended contracts. Sprint spokesman Matt Sullivan said in an interview Monday that it’s impossible to estimate the amount of payments the company might be liable for due to the consent judgment. The company denies any wrongdoing and agreed to the consent judgment “to end expensive litigation,” Sullivan said. Ben Wogsland, a spokesman for Swanson, said in an interview Monday that Swanson’s office documented many instances in which it thinks Sprint extended contracts without notifying customers. Minnesotans who became customers of Sprint after Sept. 26, 2001, may submit a claim to Swanson’s office if they think that Sprint enrolled them in a contract or extended their contract without their authorization or knowledge, or didn’t adequately disclose the duration of the contract or contract extension, or the early termination fees that applied. Also, 450,000 customers who currently have contracts with Sprint that contain early termination penalties are eligible to file claims if their contracts were extended without permission or full disclosure, the release said. “Sprint Nextel customers whose contracts were secretly ...

Help (still) wanted: Bank of America CEO

NEW YORK (CNNMoney.com) -- Of all the headaches Bank of America faces these days, none is more painful than its ongoing quest to find a new CEO.More than a month-and-a-half has passed since Ken Lewis announced his plans to retire from the Charlotte, N.C.-based bank at the end of the year. Still, a successor has yet to emerge. Some have blamed disorganization among company board members, who were arguably caught flat footed when Lewis first made his stunning announcement at the end of September. Lewis had previously said he planned to serve until after the bank paid back the money received last fall under TARP, or the Troubled Asset Relief Program. But the government aid might be part of the problem. Over the past year, regulators pumped more than $45 billion into the nation's largest bank, nearly half of which came after Bank of America (BAC, Fortune 500) realized that the scope of losses at investment bank Merrill Lynch were much more severe than first thought. BofA agreed to buy Merrill last year just as Lehman Brothers was about to go under. As one of seven companies to get "exceptional" assistance, BofA has had to succumb to a handful of government demands, including having the pay packages of its top executives reviewed by Kenneth Feinberg, the Obama administration's so-called "pay czar".That has apparently scared away some potential successors. William Demchak, for example, a leading executive at Pittsburgh-based PNC (PNC, Fortune 500Wall Street Journal.Robert Kelly, the chairman and CEO of Bank of New York Mellon (...
