NeoMedia Technologies Inc. and Scanbuy Inc. announced they have settled all pending litigation between the companies and have granted non-exclusive patent licenses to each other. NeoMedia and Scanbuy have agreed to terminate all pending litigation brought by NeoMedia against Scanbuy in 2004, and by Scanbuy and Marshall Feature Recognition, LLC ('MFR') against NeoMedia in 2008. In addition, NeoMedia has granted Scanbuy a royalty bearing, non-exclusive license to a portion of its patent portfolio in the U.S. In turn, Scanbuy has granted NeoMedia a fully paid, irrevocable, non-exclusive license of Scanbuy patents and a fully paid, non-exclusive sublicense to all of the patents licensed by MFR to Scanbuy within the U.S. This agreement will enable consumer brands, advertising agencies and mobile operators to confidently engage with either company to implement mobile barcode solutions in the U.S. The technology has enormous potential to become a viable and widely adopted communication channel.

Bems has partnered with NeoMedia Technologies to distribute 2D barcode solutions throughout Latin America. Bems announced it had been chosen by Telefonica International as its exclusive partner to develop a 2D barcode business in Latin America for the next 4 years. Bems has chosen NeoMedia as their primary technology and platform vendor for mobile barcode reading and campaign management, with a key focus on the brand marketing and advertising sectors. In addition, Bems will promote NeoMedia hardware solutions related to ticketing and couponing. As a key part of this platform, NeoReader will be the preferred barcode reader for pre-installation on handsets and all code transactions will be routed through the NeoMedia infrastructure. The solution will be distributed to markets including Argentina, Brazil, Chile, Columbia, Ecuador, El Salvador, Guatemala, Mexico, Nicaragua, Panama, Peru, Venezuela and Uruguay. This initiative to promote 2D barcode technology is part of a wider strategic plan for the operators to introduce cutting edge tools for mobile to the Latin-American market. Operators will leverage the expertise the Bems/NeoMedia partnership provides in areas such as technology, marketing, R+D and an extensive sales force to enable the widespread adoption of this technology.

On October 2, 2009, NeoMedia Technologies Inc. entered into a four year agreement with NeuStar Inc. in which the company granted to NeuStar a non-exclusive license to a portion of the company's patent portfolio primarily for the purpose of establishing and providing Registry and Clearinghouse services within the Field of Use and Territor. The terms of the License Agreement also grant to Neustar an exclusive right to sub-license that same portion of the company's patent portfolio within the Field of Use and Territory to Resolution Authorities for a period of not less than one year, but up to four years depending on the achievement of certain milestones as set forth in the License Agreement. In addition, Neustar will perform certain Reservations, Administration, Billing & Collection and other Additional Services for the benefit of the company, Neustar and the sub-licensees.
