Teva Files Amended Complaint Against Momenta Pharmaceuticals Inc./Sandoz, Inc

Teva Pharmaceutical Industries Ltd. announced it is seeking to amend its existing complaint against Momenta Pharmaceuticals Inc./Sandoz Inc. to include patent infringement of three additional patents related to the characterization of COPAXONE (glatiramer acetate injection). The proposed updated complaint has been filed under seal with the U.S. District Court for the Southern District of New York along with a motion requesting that the Court grant Teva leave to amend. Teva originally filed suit against Momenta/Sandoz in August 2008 for infringement of multiple patents (seven in the Orange Book which extend through May 24, 2014), covering the chemical composition of COPAXONE, pharmaceutical compositions containing it and methods of using it. Teva seeks leave to amend its complaint to include the additional patents related to the characterization of the active ingredient in COPAXONE. These patents do not expire until several years after the patents currently in litigation.

Momenta Pharmaceuticals Inc. reported unaudited consolidated earnings results for the third quarter and nine months ended September 30, 2009. For the third quarter of 2009, the company reported a net loss of $14.65 million or $0.38 per basic and diluted share compared with a net loss of $16.0 million or $0.45 per basic and diluted share for the same period in 2008. Collaboration revenue for the third quarter of 2009 was $4.0 million compared to the $3.9 million revenue for the same period last year. The increase in revenue was due to increased reimbursable expenditures on collaborative programs partnered with Sandoz. Loss from operations was $14.54 million compared to $16.44 million for the same period a year ago. For the nine months ended September 30, 2009, the company reported net loss of $49.32 million or $1.27 per basic and diluted share on collaboration revenue of $14.6 million compared to net loss of $44.27 million or $1.24 per basic and diluted share on collaboration revenue of $11.63 million for the same period in 2008. Loss from operations was $49.32 million compared to $44.27 million for the same period a year ago.

Momenta Pharmaceuticals Reports Financial Results for the Third Quarter of 2009
CAMBRIDGE, Mass., Nov. 5, 2009 (GLOBE NEWSWIRE) -- Momenta Pharmaceuticals, Inc. (Nasdaq:MNTA - News), a biotechnology company specializing in the characterization and engineering of complex drugs, today reported its financial results for the third quarter ended September 30, 2009. For the third quarter of 2009, the Company reported a net loss of $14.6 million, compared with a net loss of $16.0 million for the same period last year. At September 30, 2009, the Company had cash, cash equivalents, and marketable securities of $107.3 million, compared with $108.5 million at December 31, 2008. "In September we strengthened our balance sheet with the completion of a $46.8 million stock offering," said Craig A. Wheeler, President and Chief Executive Officer. "We were particularly pleased to secure the financing in light of the challenging economic environment and view it as a strong validation of the value of Momenta's pipeline."
