On 11/13/2009, Eternal Energy Corp. announced that they will be unable to file their next 10-Q by the deadline required by the SEC.

Eternal Energy Corp. announced drilling and production updates. The drilled and put on production a well in the Flat Lake area of southeast Saskatchewan. The company owns a five-percent (5%) ORRI on all Bakken production in 37,920 acres and a four-percent (4%) ORRI on all Bakken production in an additional 14,080 acres in the Ryland/Triaxon joint venture project area. The recent well, located at 1-22-1-14W2, was put on artificial lift in August of this year. It is located approximately 7 miles northeast of the initial producing well drilled by TriAxon on a contiguous lease block owned by Ryland. The new well is currently producing approximately 200 barrels of oil per day at a 35% water cut and a high pumping fluid level.

Eternal Energy Corp. announced that it has favorably settled its lawsuit with Zavanna LLC, Prairie Petroleum Inc., Trapper Oil Company Inc. and Zavanna Canada Corporation. Under the terms of the settlement agreement filed in Denver District Court on July 8, 2009, the Plaintiffs agreed to pay the company $255,000 (Settlement Payment) and to dismiss with prejudice all claims against the company and its President, Brad Colby, in exchange for the company's dismissal with prejudice of all counterclaims made by the company. The Settlement Payment will be paid to the company in two installments over the course of the next sixty days.
