Judge Tosses Ex-Dictator's Suit Against Activision

Manuel Noriega's lawsuit over his inclusion in a 2012 'Call of Duty' video game has been dismissed by a judge who determined the game's use of his likeness is protected by the First Amendment. Superior Court Judge William Fahey's ruling determined that Activision Blizzard, Inc. created a complex and multi-faceted game, 'Call of Duty: Black Ops II,' and it relied very little on the inclusion of Noriega in a pair of missions. Noriega had sought unspecified damages in the lawsuit, which Fahey ruled cannot be amended or re-filed. Noriega sued Activision in July, claiming the company depicted him as a killer and enemy of the state. The game features a story line in which players capture Noriega, who then helps the game's villain.

Activision Blizzard Patent Infringement Markman Hearing Completes

The Markman hearing for the patent infringement suit by Worlds Inc. against Activision Blizzard, Inc., Blizzard Entertainment, Inc. and Activision Publishing, Inc. (Activision Blizzard et al), was held October 3, 2014 to address various aspects of the infringement suit claims and how the words in the 11 disputed "constructions" in the claims should be construed for jury consideration. The additional purpose is for the court to determine the meaning and intent of the language used in the claims. As is typical in Markman Hearings, no ruling was issued from the bench by Judge Denise Casper of the United District Court for the District of Massachusetts. The court gave no indication of when it would issue the ruling.

[Reuters] - Vivendi will have "significant" means to reward shareholders with buy-backs or dividends after it receives the proceeds from selling its stakes in video games publisher Activision Blizzard and Maroc Telecom, its finance chief said on Thursday. Speaking at a Morgan Stanley investor conference in Barcelona, Chief Financial Officer Philippe Capron said the board had not yet decided on the exact size or form of the return to shareholders, which will come amid a broader revamp at the group as it seeks to exit telecoms to focus more on media. The board's decision will also be affected by Vivendi's plan to split into two companies next year by publicly listing its largest unit, the French mobile telecoms network operator SFR, in the middle of the year. The remaining businesses - Universal Music Group, pay-television operator Canal Plus and its Brazilian telecoms firm GVT - will be in the media-focused company, according to the plan.
Activision Blizzard lowers outlook for fourth quarter
[Reuters] - Video game publisher Activision Blizzard Inc, known for its "Call of Duty" franchise, said it raised its 2013 forecast but lowered its revenue estimates for the current quarter after warning that it could face a challenging holiday period. Despite a bump in its 2013 forecast, Activision "cautioned that there is some execution risk in Q4," Benchmark Company analyst Mike Hickey said. For the fourth-quarter, which is its crucial holiday period, Activision lowered its non-GAAP revenue forecast to $2.22 billion from its prior expectation of $2.25 billion. This fell short of Wall Steet's estimate of $2.29 billion, according to Thomson Reuters I/B/E/S.
