GreenShift Files Infringement Lawsuit against GEA Westfalia


GreenShift Corporation (OTC Bulletin Board: GERS) announced today that its wholly-owned subsidiary, GS CleanTech Corporation, has filed a legal action in the United States District Court (Southern District of New York) against GEA Westfalia Separator, Inc. and others in the industry for infringing on GreenShift’s U.S. patent covering corn oil extraction technology.


The complaint alleges that GEA Westfalia Separator, Inc. (“Westfalia”) and others in the industry infringed U.S. Patent No. 7,601,858, titled "Method of Processing Ethanol Byproducts and Related Subsystems” (the “’858 Patent”). The '858 Patent covers processes for recovering corn oil by evaporating, concentrating and mechanically processing thin stillage, a precursor to the distillers grain co-product of corn ethanol production (“DDGS”).


A typical ethanol plant converts each 56-pound bushel of corn it receives into 18 pounds of ethanol, 18 pounds of carbon emissions, and 18 pounds of DDGS. Every kernel of corn has a fat (corn oil) content of about 3.6%. This corresponds to about 2 pounds of corn oil per bushel of corn.


GreenShift’s Intellectual Property Portfolio provides ethanol production facilities with efficient processes for extracting upwards of 1.4 pounds of corn oil per bushel in a way that also reduces the amount of energy needed to refine ethanol out of corn by as much as 9,000 Btu per gallon of ethanol produced. This energy savings corresponds to a dramatic reduction in the fossil fuel consumption and carbon emissions of the host ethanol facility.


The U.S. ethanol industry produced more than 30 billion gallons of ethanol between 1980 and 2004, the year that GreenShift’s team demonstrated, for the first time, the feasibility of GreenShift’s now patented corn oil extraction technology. During that same period, about 7.4 million tons of corn oil passed untouched through the ethanol industry and was fed to livestock for a fraction of its value bound within 65 million tons of DDGS. Further, by leaving the corn oil in its DDGS, the industry was less energy efficient and consumed more energy than necessary to dewater and dry the DDGS.


For context, the ethanol industry has the capacity to produce about 11.5 billion gallons of ethanol during 2009. With a majority of plants adopting GreenShift’s Intellectual Property Portfolio, the ethanol industry could be saving about 100 million MMBtu per year while producing more than 2.8 million tons of inedible corn oil per year. The result at current market prices is staggering: the ethanol industry could be producing an additional $0.13 per gallon of ethanol produced, or over $1.1 billion, in additional profit today by using GreenShift’s patented and patent-pending corn oil extraction technologies. And, this excludes the impact of premiums paid for defatted DDGS in some markets, and the value of shaving tens of millions of metric tons per year of greenhouse gas (“GHG”) emissions off of America’s carbon footprint.

GreenShift Awarded Patent for Corn Oil Extraction

GreenShift Corporation (OTC Bulletin Board: GERS) announced today that the U.S. Patent and Trademark Office has issued U.S. Patent No. 7,601,858, titled "Method of Processing Ethanol Byproducts and Related Subsystems” (the ’858 Patent) for the extraction of corn oil to GS CleanTech Corporation, a wholly-owned subsidiary of GreenShift.


GreenShift’s patented and patent-pending corn oil extraction technologies enable GreenShift and its licensees to “drill” into the back-end of first generation corn ethanol plants to tap into a new reserve of inedible crude corn oil with an estimated industry-wide output of about 20 million barrels per year. This corn oil is a valuable second generation feedstock for use in the production of biodiesel and renewable diesel – advanced carbon-neutral liquid fuels, thereby enhancing total fuel production from corn and increasing ethanol plant profits.

Yes, this puppy is undervalued. It is not a pump and dump imo. It got a patented technology for extracting corn oil. Even though, algae is the next big thing but even that has been around for over 20 years. Corn oil however is a sure thing.

As an update to the EPA analysis, GreenShift now has five operating corn oil extraction facilities. In addition, GreenShift has proven that it can extract upwards of 6.5 gallons of previously unrecovered inedible crude corn oil from
the distillers grain co-product of corn ethanol production for every 100 gallons of ethanol produced. This translates to a total market opportunity of 680 million gallons per year of inedible feedstock for conversion into advanced biofuel with the U.S. corn ethanol complex producing 10.5 billion gallons per
year. 40% of the total market opened up by GreenShift`s extraction technologies is about 270 million gallons per year. GreenShift has about 6% of this market today with its existing agreements to extract 40 million gallons per year of
corn oil for refining into biodiesel or renewable diesel.

Lets say at the would sell each gallon at .03 cent (270 mil gallons). This equate to just over 8 million dollars.

proprietary corn oil extraction technologies have been included in the analyses
completed by the U.S. Environmental Protection Agency ("EPA") on the
contribution of corn ethanol to the renewable fuels industry.

GreenShift`s corn oil extraction technologies make possible the production of
biodiesel from inedible corn oil, a previously untapped feedstock entrained in
the distillers` grain co-product of corn ethanol production. This increases the
yield of biofuel from corn by 7% while reducing the amount of fossil fuels used
in the corn ethanol production process by up to 10%.

On May 5, 2009, the EPA signed a notice of proposed rulemaking, Regulation of
Fuels and Fuel Additives: Changes to Renewable Fuel Standard Program (the "RFS2
Program"), which was supported by a Draft Regulatory Impact Analysis ("DRIA")
made available on the same date. These two documents were drafted to solicit
comments pertaining to proposed new rules to increase requirements to use
renewable fuels as an important part of the nation`s transportation fuel supply.
The EPA specifically refers to GreenShift`s corn oil extraction technologies in
the RFS2 notice and the DRIA:

* "The corn oil process on which we have chosen to focus for cost and volume
estimates in this proposal is one that extracts oil from the thin stillage after
fermentation (the non-ethanol liquid material that typically becomes part of
distillers` grains with solubles). We believe installation of this type of
equipment will be attractive to industry because it can be added onto an
existing dry mill plant and does not impact ethanol yieldssince it does not
process the corn prior to fermentation."
* "According to economic analyses done by USDA based on the GS CleanTech
[GreenShift`s wholly-owned cleantech development subsidiary] corn oil extraction
process, the capital cost to install the system for a 50 [million gallon per
year] ethanol plant is approximately $6 million."
* "In an adjustment to the traditional dry mill ethanol process, corn oil is
removed after the ethanol distillation process from the syrup using centrifuges.
With this adjustment a 100 [million gallon per year] plant can produce an
additional 7 million gallons of corn oil (biodiesel) and thus increase [an
ethanol] plant`s fuel production by 7%."
* "Depending on the configuration, such a system can extract 20-50% of the oil
from the co-product streams, and produces a distressed corn oil (non-food-grade,

Bioethanol production process may be improved by new technologies

GreenShift Corporation has developed new techniques for enhancing biofuel yield and increasing producers revenue. Bioethanol fuel is usually obtained by fermenting sugar from different feedstock - corn, potato, molasses and other biomass. Crude alcohol is then distilled and dehydrated to yield ethanol fuel E100 which can be mixed within gasoline in any blend (E10, E20, E30, E85..). Obviously, fermentation process is quite simple. Under anaerobic conditions, enzymes in yeast convert glucose and sucrose to ethanol. The bigger challenge for scientists is pre-fermentation conversion of the crude corn oil to simple sugar.

GreenShift Corporation recently patented "Method of Processing Ethanol Byproducts and Related Subsystems” U.S. Patent and Trademark Office has issued U.S. Patent No. 7.601.858, (titled the ’858 Patent) for the extraction of crude corn oil.
It is a valuable second generation feedstock for use in the production of bioethanol and as a component in the production of biodiesel, thereby enhancing total fuel production from corn.
The crude corn oil is composited by chains of sugars that can be broken down into simple sugars which are fermented. Using a new corn oil extraction technology, GreenShift assures the increasing bioethanol yields by 7%. These benefits correspond to increased ethanol producer income of about $0.12 per gallon of ethanol produced at current market prices, and can be realized for less than 10% of the capital cost of the host ethanol plant. CEO of the company, Kevin Kreisler, explained that: “The issuing of the ‘858 Patent is a significant milestone for GreenShift and its stakeholders. The company has a substantial investment in the development of these important and timely new technologies. We look forward with great anticipation to working with the ethanol industry to press the evolution of corn ethanol forward into enhanced sustainability.” The company’s chief technology officer and co-inventor of its extraction technologies, David Winsness, chief technology officer and co-inventor of of GreenShift’s extraction technologies added: “There aren’t any other technologies that have been developed for corn ethanol producers that begin to approach even a fraction of these results in the entire history of the ethanol industry. While this patent establishes our dominant ownership and technology leadership in corn oil extraction, we have many more patent applications pending that strengthen GreenShift’s position as a leading technology partner in the ethanol industry.”

The company extraction technologies intercepts the syrup during evaporation process and washes the whole stillage in a series of additional centrifuges upstream of the normal centrifugation stage of the ethanol plant.
These extraction technologies have recently been cited by the U.S. EPA in its rule making processes involving the renewable fuels standard.

Every kernel of corn has a fat content of about 3.6%. It corespondents to 3.4 million tons of fat at the 9 billion gallon production level in 2008. That amount passed through the ethanol industry and wasted untouched. Successful patent implementation in bioethanol industry will take duble effect: more bioethanol fuel for cars and more eatable corn for humans.
